Terms and Conditions

1. Scope

These Terms and Conditions apply to all purchases made through this website, operated by Franziska Greis, trading as Casa Ferrier, Stöckerstr. 2, 57299 Burbach, Germany ("we," "us," "our"). By placing an order, you agree to these terms.

2. Products

We sell digital downloadable products, including but not limited to interior design guides, color palette guides, and related digital content ("Digital Products"). No physical goods are shipped. All products are delivered exclusively as digital downloads.

3. Contract formation

Product listings on our website do not constitute a binding offer, but an invitation for you to place an order. By completing checkout and submitting payment, you make a binding offer to purchase. The contract is concluded once we confirm your order by email or make the digital download available to you, whichever occurs first.

4. Prices and payment

All prices are displayed in US Dollars (USD) and are final prices. As we operate under the small business regulation (§ 19 Abs. 1 UStG), we do not charge value-added tax (VAT), and no VAT is shown on invoices. Payment is processed through Squarespace Payments at the time of purchase. Your order will only be processed once payment has been received in full.

5. Delivery of digital content

Digital Products are made available for download immediately after successful payment, typically via a download link provided on the order confirmation page and by email. You are responsible for ensuring your device and software are compatible with the file formats provided (e.g., PDF). We recommend downloading and saving your files promptly, as download links may expire after a limited period.

6. Right of withdrawal

Please refer to our separate Right of Withdrawal policy, available at withdrawal page, for full details of your statutory right to withdraw from your purchase, including circumstances under which this right does not apply due to the immediate delivery of digital content.

7. Usage rights and license

Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the Digital Product for your own private or professional reference. Unless explicitly stated otherwise for a specific product, you may not resell, redistribute, share, publicly publish, or commercially license the Digital Product, in whole or in part, to any third party. All content remains the intellectual property of Franziska Greis / Casa Ferrier.

8. Availability and technical issues

While we take reasonable care to ensure all download links function correctly, we cannot guarantee uninterrupted access due to circumstances outside our control (e.g., hosting outages). If you experience a technical issue accessing your purchase, please contact us at hello@casaferrier.com and we will resolve this promptly, including providing a new download link where necessary.

9. Liability

We are liable without limitation for damages resulting from injury to life, body, or health caused by us, and for damages caused by intentional or grossly negligent breach of duty by us. For damages resulting from the breach of a material contractual obligation (a "cardinal obligation," the fulfillment of which is essential to the proper performance of the contract) caused by simple negligence, our liability is limited to the foreseeable damage typical for this type of contract. Liability beyond this is excluded.

10. Changes to these terms

We reserve the right to update these Terms and Conditions from time to time. Changes will not affect orders already placed. The current version at the time of your purchase applies to that transaction.

11. Governing law and jurisdiction

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of protections granted by mandatory provisions of the law of your country of habitual residence. Where legally permissible, the place of jurisdiction for any disputes is Burbach, Germany.

12. Severability

If any provision of these terms is or becomes invalid, this does not affect the validity of the remaining provisions.
